Judgment proof
by: Gerri

I am sorry to hear what a difficult time you and your wife are going through. I am not sure I understand your situation however. It is not typical to be in a Chapter 7 bankruptcy for a year and a half. It is usually a pretty quick process. Do you mean you completed it a year and a half ago?

If that's your question, then it's recent enough after your bankruptcy that you should be able to go back to the attorney who handled your bankruptcy and ask them. I assume you are, but I'm not certain how pensions are handled in your state. Your Social Security should be safe from creditors as long as it's not mingled with other non-exempt funds. Again, I wish I could say for sure but I'd suggest you ask your attorney.
